STANDARD TERMS & CONDITIONS FOR SUPPLY OF SERVICE.
By purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions.
Please read these Terms of Service carefully before engaging us as your service provider.
1 INTERPRETATION
In this document the following words shall have the following meanings:
1.1 “Customer” means any person who purchases Services from the Supplier.
1.2 “Supplier” means NuForm Entertainment, 7 Paterson Rd, Mt Nasura, Western Australia 6112.
1.3 “Terms and Conditions” means the terms and conditions of supply set out in this document and any special terms and conditions agreed in writing by the supplier.
1.4 "Dry Hire" means the hire of equipment under the exclusive direction and control of the Hirer.
2 GENERAL
2.1 These Terms and Conditions shall apply to all contracts for the supply of Services by the Supplier to the Customer and shall prevail over any other documentation or communication from the Customer.
2.2 Any variation to these Terms and Conditions shall be inapplicable unless agreed in writing by the Supplier.
3 PRICE AND PAYMENT
3.1 Payment for services provided must be paid at completion of services rendered or within 14 days after completion of event. Failure to do so will result in legal action.
3.2 Once a service has been ordered, the price shall remain fixed for the Customer.
3.3 Deposit Payment is required for 'Dry Hire' equipment. Deposit amounts will vary depending on amount and type of equipment hired.
4 CUSTOMER OBLIGATIONS
To enable the Supplier to perform its obligations the Customer Shall:
4.1 Co-operate with the Supplier.
4.2 Provide the Supplier with any information reasonably required by the Supplier for the effective running of the event. Including and not limited to time duration of the event and area noise restriction regulations.
4.3 Keep the Supplier notified of their correct name, postal address and all phone contacts, fax or e-mail information.
4.4 Comply with such other requirements as agreed between the parties.
4.5 Provide adequate power supplies that comply with the code of Australian Standards within venue. If unable, the provision and set up of a Generator will need to be obtained which shall comply with Australian Standards.
4.6 Ensure adequate cover is in place for protection from weather for all Supplier equipment, unless otherwise instructed by Supplier.
4.7 Be aware that any racism, insults or violence will not be tolerated by contractors, performers, patrons or venue employees. Failing to comply, will initiate an immediate pack down of all equipment and a full charges will apply.
5 SUPPLIER OBLIGATIONS
5.1 The Supplier shall perform the Service with reasonable skill and care and to a reasonable standard in accordance with recognised standards and codes of practice.
5.2 The Supplier accepts all responsibility for the condition of equipment used in the performance of the Services and shall ensure that any equipment supplied shall be free of defects.
5.3 The Supplier at completion of event shall do their utmost to ‘Bump out’ in a non-evasive and timely manor.
6 LIMITATION OF LIABILITY
6.1 Nothing in these Terms and Conditions shall exclude or limit the liability of the Supplier for death or personal injury. However the Supplier shall not be liable for any direct loss or damage suffered by the Customer howsoever caused, as a result of any negligence, breach of contract or otherwise in excess of the price of the service.
6.2 The Supplier shall not be liable under any circumstance to the Customer or any third party for any indirect or consequential loss of profit or other economic loss suffered by the consumer howsoever caused, as a result of any negligence, breach of contract, misrepresentation or otherwise.
7 CANCELLATIONS
7.1 In the event of a cancellation the Customer must give 14 days notification before the event date otherwise a cancellation fee of $200 will apply. For events with a total price of over $2,000 a percentage of 20% will apply.
8 BOOKINGS
8.1 A minimum 30 days notification before event date is required when making a booking.
8.2 Any bookings made within 30 days of an event will be subject to equipment availability, Supplier booking availability and may incur base price additions.
9 FORCE MAJEURE
Neither party shall be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God, strikes, lock outs, accidents, war, fire, and the party shall be entitled to a reasonable extension of its obligations.
10 USE OF SUPPLIER EQUIPMENT
10.1 All Supplier equipment that has been hired for private use is not to be handled or moved by any persons other than NuForm Entertainment personnel or by the hiring musician. Any damage as a result will become liable by the Customer.
11 COPYRIGHT
11.1 Copyright regulations will apply to all performance events were services are rendered by the Supplier. Any video tapping of the event or recording of audio is strictly prohibited unless prior confirmation has been sort from NuForm Entertainment.
